ISSUE + RULE
The issue is whether [X's conduct] in trade or commerce was misleading or deceptive or likely to mislead or deceive the relevant audience contrary to ACL s 18.
Section 18 applies objectively to conduct in trade or commerce. The court identifies the relevant audience, determines the dominant message in context and asks whether an ordinary or reasonable member of that class would be led into error. Intention and fault are not required.
