A representation about a future matter is treated as misleading where the representor lacks reasonable grounds. If the predicted event does not occur, the representor bears the evidential burden of showing reasonable grounds, although failure of the prediction alone does not automatically decide every issue.

Section 29 targets specific false or misleading representations about the standard, quality, value or grade of goods or services; whether goods are new; sponsorship, approval or affiliation; performance characteristics, uses or benefits; price; origin; repair facilities and spare parts; need; and consumer rights, guarantees or remedies.

The ACL separately regulates representations concerning land under s 30, employment under s 31, goods and services promoted to the public under ss 33-34, and business activities or profitability under s 37. Employment representations are notable because s 31 does not use the ordinary trade-or-commerce wording.

Section 32 governs gifts, prizes and rebates; s 35 prohibits bait advertising without reasonable supply; and s 36 prohibits accepting payment without intending or being able to supply as represented and requires supply within the agreed or a reasonable time. These provisions can carry civil penalties and corresponding criminal offences.
